Terms of Service

These Terms of Service ("Terms") govern the supply of Mac hosting and related services by AITEST S.R.L., registration number J2024035731001, tax identification number 50782124, VAT ID RO50782124, with its registered office at Strada Constanței nr. 15, Bloc E1, Sc. D, Et. 3, Ap. 59, Năvodari, Constanța County, Romania ("MacDuty", "we", "us"), to you ("Customer", "you"). By ordering a service you accept these Terms, together with our Acceptable Use Policy and Privacy Policy, which form part of this agreement.
1. The service
We rent you a dedicated Apple Mac mini, installed in our facility in Romania, together with power, cooling, network connectivity, a public IPv4 address and IPv6 allocation, and remote access to the machine. The Mac is allocated to you alone for the duration of your subscription. There is no virtualisation and no other customer on your machine.
We do not sell you the hardware. The Mac and all associated equipment remain our property at all times.
2. Ordering and provisioning
Your subscription begins when we make the Mac available to you and send your access credentials. Machines listed as available are normally provisioned within minutes of payment. Machines listed with a lead time are provisioned within the period stated at checkout. We may carry out verification checks before provisioning in order to prevent fraud and abuse; where verification is required, we will contact you promptly.
3. Prices, billing and taxes
Prices are stated on our website in EUR or USD and exclude VAT. VAT is applied at checkout in accordance with applicable law. Business customers in the European Union who provide a valid VAT identification number are invoiced under the reverse charge mechanism.
Subscriptions are billed in advance, for the term you select: daily (minimum 24 hours), monthly, or annually. Your price is fixed for each term and will not change during a term. We may change prices for future terms with at least 30 days' written notice; if you do not accept a price change, you may cancel with effect from the end of your current term.
Payment is taken by card or other supported method through our payment provider. We do not store your card details.
4. Renewal, failed payments and suspension
Subscriptions renew automatically for the same term unless cancelled beforehand. We send a renewal reminder before each renewal.
If a payment fails, we will notify you by email immediately and separately from any renewal reminder, and will retry the payment over the following three days. If payment is still not received:
- your service is suspended on day 7 after the failed payment. The Mac is powered off and your data is preserved intact;
- your data is retained for a further 7 days, during which you may restore service by paying the outstanding amount, or request an export of your data;
- after day 14, the Mac is erased and returned to our pool.
We will not continue to invoice you for a service that has been suspended for non-payment, and we will not delete your data before the periods above have elapsed.
5. Cancellation and the right of withdrawal
You may cancel at any time with effect from the end of your current billing term. Cancellation takes effect at the end of the paid period; we do not refund unused portions of a term except as set out below.
If you are a consumer resident in the European Union, you have a statutory right to withdraw from this agreement within 14 days of concluding it, without giving reasons. If you ask us to begin providing the service before the end of that period, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully provided; where the service has been partially provided, you pay a proportionate amount for what you used.
In addition, and regardless of the above, we offer a 14-day money-back guarantee on your first monthly subscription. If you are not satisfied, tell us within 14 days of your first order and we will refund it in full.
6. Your obligations
You must use the service in accordance with our Acceptable Use Policy. You are responsible for the security and administration of your Mac, for all software you install, for all content and data you process on it, and for maintaining your own backups.
You must not enable Activation Lock, associate the Mac with a Find My account, set a firmware password, or otherwise take any action that prevents us from recovering, erasing or reusing the hardware. Doing so is a material breach of these Terms, and you are liable for the full replacement cost of the machine.
You must not resell, sublicense or share access to the service in breach of Apple's software licence terms.
7. Backups and data
The service does not include backups. You are solely responsible for backing up your data. Optional backup storage may be offered as a separate paid service; where it is, it does not relieve you of responsibility for your own backup strategy.
On termination or expiry of your subscription, and after the retention periods in clause 4, we securely erase the machine. Erased data cannot be recovered.
8. Availability, maintenance and hardware failure
We aim for a service availability of 99.9% per calendar month, excluding scheduled maintenance, which we announce in advance where practicable, and excluding events outside our reasonable control.
If your Mac suffers a hardware failure, we will replace it with an equivalent machine as quickly as possible, normally within one business day, and will make reasonable efforts to transfer your storage device. We cannot guarantee that data on a failed device can be recovered.
Where we fail to meet the availability target in a given month, your sole remedy is a pro-rata credit against the affected period, applied to your next invoice, upon your request within 30 days.
9. Our rights of suspension and termination
We may suspend or terminate the service immediately where you are in material breach of these Terms or the Acceptable Use Policy, where required by law or by a competent authority, or where your use presents an immediate risk to our network, our IP reputation, or third parties. Where circumstances allow, we will notify you first and give you an opportunity to remedy the issue.
Either party may terminate for convenience with effect from the end of the current billing term.
10. Liability
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under Romanian or EU law, including consumers' statutory rights.
Subject to that, we are not liable for loss of profit, loss of business, loss of data, loss of goodwill, or any indirect or consequential loss, however arising. Our total aggregate liability in respect of any claim is limited to the amounts paid by you for the service in the three months preceding the event giving rise to the claim.
11. Intellectual property and Apple
MacDuty is not affiliated with, endorsed by, or sponsored by Apple Inc. Apple, Mac, Mac mini and macOS are trademarks of Apple Inc. Your use of macOS is subject to Apple's software licence agreement, which you accept directly with Apple.
12. Confidentiality and data protection
We process personal data in accordance with our Privacy Policy and the GDPR. Where we process personal data on your behalf, a data processing agreement is available on request and applies to that processing. Our staff do not access your Mac or its contents except where you request support, where necessary to maintain the service, or where required by law.
13. Changes to these Terms
We may update these Terms. Material changes will be notified by email at least 30 days before they take effect. If you do not accept them, you may terminate with effect from the date they would apply.
14. Governing law and disputes
These Terms are governed by Romanian law. Consumers retain the protection of the mandatory provisions of the law of their country of residence and may bring proceedings in their local courts. For business customers, the courts of Constanța, Romania, have exclusive jurisdiction. A consumer may also complain to ANPC, the Romanian consumer protection authority, and use its alternative dispute resolution scheme at anpc.ro/sal. A consumer in another EU country can find their own national scheme through the European Commission's consumer redress portal at consumer-redress.ec.europa.eu. The Commission's online dispute resolution platform closed on 20 July 2025 and is no longer an option.
15. Entire agreement
These Terms, the Acceptable Use Policy and the Privacy Policy constitute the entire agreement between us regarding the service and replace any prior understanding.
