Terms of Service
Last updated: 29 October 2026
These Terms of Service ("Terms") govern the supply of Mac hosting and related services by AITEST S.R.L., registration number J2024035731001, tax identification number 50782124, VAT ID RO50782124, with its registered office at Strada Constanței nr. 15, Bloc E1, Sc. D, Et. 3, Ap. 59, Năvodari, Constanța County, Romania ("MacDuty", "we", "us"), to you ("Customer", "you"). By ordering a service you accept these Terms, together with our Acceptable Use Policy and Privacy Policy, which form part of this agreement.
1. The service
We rent you a dedicated Apple Mac mini, installed in our facility in Romania, together with power, cooling, network connectivity, a public IPv4 address and IPv6 allocation, and remote access to the machine. The Mac is allocated to you alone for the duration of your subscription. There is no virtualisation and no other customer on your machine.
We do not sell you the hardware. The Mac and all associated equipment remain our property at all times.
To run and protect the service, each Mac is enrolled in our device management and carries a small monitoring agent. Once a minute the agent reports how busy the processor and graphics are and how much memory and disk is in use; it reads no files, no application or process names, no screen content and no keystrokes. If you choose RustDesk, its server runs on your Mac and is configured by us. You must not remove or disable these components; doing so may prevent us from providing or protecting the service.
2. Ordering and provisioning
Your subscription begins when we make the Mac available to you and its access credentials appear in your account. Machines listed as available are normally provisioned within minutes of payment. Machines listed with a lead time are provisioned within the period stated at checkout. We may carry out verification checks before provisioning in order to prevent fraud and abuse; where verification is required, we will contact you promptly.
3. Prices, billing and taxes
Prices are stated on our website in EUR or USD and exclude VAT. VAT is applied at checkout in accordance with applicable law. Business customers in the European Union who provide a valid VAT identification number are invoiced under the reverse charge mechanism.
Subscriptions are billed in advance, for the term you select: daily (minimum 24 hours), weekly, monthly, or annually. Your price is fixed for each term and will not change during a term. We may change prices for future terms with at least 30 days' written notice; if you do not accept a price change, you may cancel with effect from the end of your current term.
Payment is taken by card or other supported method through our payment provider. We do not store your card details.
Partner coupons. A coupon code from a MacDuty hosting partner lowers the price of a Mac for the months shown at checkout. The discount is granted by the partner. If the partner stops hosting with MacDuty, the discount may end before those months are over. We email you at least 30 days before the full price applies, and you may cancel the rent before that date at no cost. A coupon is used once per customer and not together with the launch offer.
4. Renewal, failed payments and suspension
Subscriptions renew automatically for the same term until cancelled. For monthly and annual terms we email you a reminder seven days before each renewal; daily and weekly terms renew without one.
If a renewal payment fails, access to the Mac is blocked straight away and we notify you by email. The Mac keeps running and your data is preserved intact. Our payment provider retries the payment over the following days, and you may restore the service at any time by paying the outstanding amount, which gives you back access within minutes, with the same login. If payment is still not received:
- on a monthly or annual term, the service ends three days after the failed payment;
- on a daily or weekly term, which is bought one period at a time, the service ends 24 hours after the failed payment.
When the service ends, the subscription is cancelled so that nothing further is charged, and the Mac is erased and returned to our pool. Erasure cannot be undone.
We will not continue to invoice you for a service that has been suspended for non-payment, and we will not erase your data before those periods have passed.
5. Cancellation and the right of withdrawal
You may cancel at any time from the Billing tab of your Mac in your account. Cancellation takes effect at the end of the period you have already paid for: the service runs until then, nothing further is charged, and the Mac is erased at that moment, so copy off anything you want to keep before then. Until that moment you can undo the cancellation from the same place. We do not refund unused portions of a term, except on a withdrawal as set out below.
If you are a consumer, you have the right to withdraw from this contract within 14 days of concluding it, without giving any reason. The contract is concluded when you place your order.
To withdraw, press Withdraw from the contract on the Billing tab of your Mac, or send us a clear statement of your decision by email to [email protected] or by post to the address above. You may use the model withdrawal form below, but you do not have to. It is enough that you send your statement before the 14 days have passed.
The service can only begin within the withdrawal period at your express request, so at checkout we ask you to confirm that you want it to start immediately. If you then withdraw, you pay for what was provided, counted in days at the daily share of the price of your term. Apple's licence for macOS allows a Mac to be leased only for periods of at least 24 consecutive hours, so the day in progress when you withdraw, counted from the start of the current billing period, runs to its end and is paid for; we refund the days not begun. On a daily term the day in progress is the whole term, so nothing is refunded. When that day ends, the service stops and the Mac is erased.
We refund you without undue delay and in any event within 14 days of the day we are informed of your decision to withdraw, using the same means of payment you used, unless you expressly agree otherwise. You incur no fees as a result of the refund. We confirm your withdrawal by email.
Business customers have no right of withdrawal and may cancel as described above.

6. Your obligations
You must use the service in accordance with our Acceptable Use Policy. You are responsible for the security and administration of your Mac, for all software you install, for all content and data you process on it, and for maintaining your own backups.
You must not enable Activation Lock, associate the Mac with a Find My account, set a firmware password, or otherwise take any action that prevents us from recovering, erasing or reusing the hardware. Doing so is a material breach of these Terms, and you are liable for the full replacement cost of the machine.
You must not resell, sublicense or share access to the service in breach of Apple's software licence terms.
7. Backups and data
The service does not include backups. You are solely responsible for backing up your data. Optional backup storage may be offered as a separate paid service; where it is, it does not relieve you of responsibility for your own backup strategy.
On termination or expiry of your subscription, and after the retention periods in clause 4, we securely erase the machine. Erased data cannot be recovered.
8. Availability, maintenance and hardware failure
We aim for a service availability of 99.9% per calendar month, excluding scheduled maintenance, which we announce in advance where practicable, and excluding events outside our reasonable control.
If your Mac suffers a hardware failure, we will replace it with an equivalent machine, normally the same day. Data stored on a failed Mac cannot be transferred or recovered.
Where we fail to meet the availability target in a given month, your sole remedy is a pro-rata credit against the affected period, applied to your next invoice, upon your request within 30 days.
9. Technical support diagnostics
In force from 2 December 2026.
When you open a technical support ticket about a Mac you rent from us, you instruct us to run read-only diagnostics on that Mac to find the cause. These cover disk and volume sizes, snapshots, the causes of shutdowns and restarts, pending updates and the state of our management agent. They never read your files, their names or their content. We change nothing on the Mac without your explicit written consent on the ticket: no restart, update, deletion, installation or change of settings. For a Mac you own that we host for you (colocation), we run diagnostics only after you agree on the ticket.
10. Our rights of suspension and termination
We may suspend or terminate the service immediately where you are in material breach of these Terms or the Acceptable Use Policy, where required by law or by a competent authority, or where your use presents an immediate risk to our network, our IP reputation, or third parties. Where circumstances allow, we will notify you first and give you an opportunity to remedy the issue.
Either party may terminate for convenience with effect from the end of the current billing term.
11. Liability
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under Romanian or EU law, including consumers' statutory rights.
Subject to that, we are not liable for loss of profit, loss of business, loss of data, loss of goodwill, or any indirect or consequential loss, however arising. Our total aggregate liability in respect of any claim is limited to the amounts paid by you for the service in the three months preceding the event giving rise to the claim.
12. Intellectual property and Apple
MacDuty is not affiliated with, endorsed by, or sponsored by Apple Inc. Apple, Mac, Mac mini and macOS are trademarks of Apple Inc. Your use of macOS is subject to Apple's software licence agreement, which you accept directly with Apple.
13. Confidentiality and data protection
We process personal data in accordance with our Privacy Policy and the GDPR. Where we process personal data on your behalf, a data processing agreement is available on request and applies to that processing. Our staff do not access your Mac or its contents except where you request support, where necessary to maintain the service, or where required by law.
14. Changes to these Terms
We may update these Terms. Material changes will be notified by email at least 30 days before they take effect. If you do not accept them, you may terminate with effect from the date they would apply.
15. Governing law and disputes
These Terms are governed by Romanian law. Consumers retain the protection of the mandatory provisions of the law of their country of residence and may bring proceedings in their local courts. For business customers, the courts of Constanța, Romania, have exclusive jurisdiction. A consumer may also complain to ANPC, the Romanian consumer protection authority, and use its alternative dispute resolution scheme at anpc.ro/sal. A consumer in another EU country can find their own national scheme through the European Commission's consumer redress portal at consumer-redress.ec.europa.eu. The Commission's online dispute resolution platform closed on 20 July 2025 and is no longer an option.
16. Entire agreement
These Terms, the Acceptable Use Policy and the Privacy Policy constitute the entire agreement between us regarding the service and replace any prior understanding.
